1. Agreement to Terms

These Terms of Service constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you") and Tasman Tech ("we," "us" or "our"), concerning your access to and use of our website and services. You agree that by accessing the site, you have read, understood and agree to be bound by all of these Terms of Service.

2. Intellectual Property Rights

Unless otherwise indicated, the Site is our proprietary property and all source code, databases, functionality, software, website designs, audio, video, text, photographs and graphics on the Site (collectively, the "Content") and the trademarks, service marks and logos contained therein (the "Marks") are owned or controlled by us or licensed to us and are protected by copyright and trademark laws.

3. User Representations

By using the Site, you represent and warrant that: (1) all registration information you submit will be true, accurate, current, and complete; (2) you will maintain the accuracy of such information and promptly update such registration information as necessary; (3) you have the legal capacity and you agree to comply with these Terms of Service.

4. Quotes, Inquiries and Project Status

Through our dashboard, you may request quotes or submit inquiries. A quote with a status of "New" or "In-Progress" is provided for informational and estimation purposes only and does not constitute a legally binding contract. A project is only legally binding once a quote is marked as "Completed" and officially signed or approved by the customer. If you wish to cancel an active project, you must follow our official project cancellation process through the dashboard or by contacting us directly. Any deposits paid prior to cancellation may be non-refundable depending on the specific project terms agreed upon at the time of approval.

5. Third-Party Services, Hosting and Domains

While Tasman Tech provides expert configuration, management and system administration services, we do not directly sell, own, or host the underlying domain names or web hosting packages. The client retains full ownership and ultimate liability for their third-party hosting accounts, domains and environments (e.g., CPanel, Linux environments, AWS, etc.). You are responsible for ensuring compliance with your hosting provider's terms of service and for maintaining the security credentials associated with those third-party accounts.

6. Prohibited Activities

You may not access or use the Site for any purpose other than that for which we make the Site available. The Site may not be used in connection with any commercial endeavors except those that are specifically endorsed or approved by us.

7. Governing Law

These Terms shall be governed by and defined following the laws of New Zealand. Tasman Tech and yourself irrevocably consent that the courts of New Zealand shall have exclusive jurisdiction to resolve any dispute which may arise in connection with these terms.
